These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Laulima Travels Limited (“we,” “us” or “our”), concerning your access to and use of the laulimatravels.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). 

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. 

We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change. 

It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions are posted. 

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. 

Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. 

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to register for the Site.

OVERVIEW OF LAULIMA TRAVELS

The Laulima Platform facilitates the connection between Travellers looking for hostel work in exchange for free accommodation and Hostels looking for Travel workers in exchange for help at their hostels. Travellers will learn, experience local culture, foster relationships and be able to travel the world for less. Hostels will have a helping hand for their business, learn from new cultures, foster new working relationships and be able to supplement their business needs for less. Travellers and Hostels are both referred to as "Users".

Laulima only CONNECTS the two users. Laulima is not party to any agreements entered into between the hostels and traveller and thus is not responsible in any way for the arrangements made between the two after the first meeting on the platform. When travellers apply for a position and are accepted, they enter into an agreement directly with the hostel. Hostels are solely responsible for what they post, what positions they make available on their profile and platform, for choosing a travel worker and making sure they meet their requirements as a business and the expectations promised to the traveller. Laulima is not a travel, employment or recruitment agency nor is Laulima an organised exchange, volunteer program or insurance company. Laulima does not monitor the Hostels and Travellers and disclaims all liability in this regard.

To promote the Laulima platform and to generate reach/interest all user content may be disclosed on other sites, in applications, e-mails, social media and online and offline advertisements.

The Laulima Platform may contain links to third party sites or resources (“Third Party Services”). These Third Party Services may be subject to different terms and conditions and privacy practices. Laulima is not responsible for the availability or accuracy of such Third Party Services, nor for the content, products or services available on these Third Party Services. The Links to these Third Party Services are not an endorsement of Laulima for such Third Party Service.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United Kingdom, foreign jurisdictions, and international conventions. 

The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms and Conditions, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

By creating, uploading, posting, sending, receiving, storing or making available any User Content on or through the Laulima Platform, you grant Laulima a worldwide, transferrable, sublicensable, perpetual (or for a period of protection), irrevocable, royalty free, non-exclusive license over said User Content, allowing us to access, use, store, copy, modify, make derivative works from, distribute, publish, transmit, forward or otherwise exploit said User Content to provide and / or promote the Laulima Platform, in any medium or platform. Except if you give specific consent, Laulima does not claim any proprietary rights over any User Content and nothing in these Terms will be deemed to restrict any rights you may have to use or exploit your User Content.

You are solely responsible for all member Content you make available on, or through, the Laulima Platform. So, you represent and warrant that: (i) you are the sole and exclusive owner of all user content that you make available on or through the Laulima Platform or you have all rights, licenses, consents and clearances required to grant Laulima the rights to such User Content, as contemplated in these Terms, and (ii) neither the User Content nor the publication, uploading, display or transmission of User Content, or the use of said User Content by Laulima (or any part thereof) will break, evict or violate a third party's patent, copyright, trademark, trade secret, moral rights or other proprietary rights or intellectual property rights, or rights of publicity or privacy, or result in violation of any applicable law or regulation.

USER REGISTRATION

You will be required to register with the Site to access certain features within the platform, these include actions such as applying, creating a profile and messaging and exchanging messages with hostels. 

You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. You must notify Laulima immediately if you become aware or have any reason to suspect that your credentials have been misplaced, stolen, misappropriated or otherwise compromised or in case of unauthorized use or suspected unauthorized use of your Account. You are responsible for any and all activity conducted through your Laulima Account, unless such activities are not authorized by you and providing that you have not been negligent (such as not reporting unauthorized use or loss of your credentials).

You can register a Laulima Account by using an e-mail address and creating a password. You have the ability to stop your registration at any time by accessing your Account page and selecting Delete Account.

You must provide current, accurate and complete information during the registration process and keep your Account information and your profile page up to date.

You may not register more than one Account, unless Laulima authorizes you to do so. You may not assign or transfer your Account to any third party.

USER REPRESENTATIONS

By using the Site, you represent and warrant that: 

(1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary;

(3) you have the legal capacity and you agree to comply with these Terms and Conditions; 

(4) you are not under the age of 18;  

(5) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; 

(6) you will not use the Site for any illegal or unauthorized purpose; 

(7) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). 

USER VERIFICATION

A “Verified User” includes Travellers and Hostels, who have subscribed to the Monthly Plan and paid the fee (“Subscription Fee”). It is to be understood that anyone who subscribes to the Monthly Plan will automatically become a Verified User and will have their billing information verified, ensuring more security and reliability to the platform. In addition, all Verified Users agree to commit and show willingness in providing a basic exchange of skills for free accommodation between Traveller and Hostel.   

Verified Traveller Users gain full access to: i) Apply, talk and confirm stay with as many Laulima hostels as they wish; ii) Assistance at all times; iii) Laulima insurance during the trip if necessary; iv) Receive and leave evaluations from and about their Hostel;

Verified Hostel Users gain full access to: i) Connect, talk and confirm stay with as many Laulima Travellers as they wish; ii) Assistance at all times; iii) Monthly advertising on all Laulima social platforms; iv) Receive and leave evaluations from and about their Traveller;

Laulima reserves the right to change Subscription Fees at any time, we will notify Users in advance in case of any fee changes before they are applied.

A Verified User can cancel their Monthly Subscription Plan at any point, they will be charged up until their 30 days have ended, starting from the date the user has selected to unsubscribe. The user account will be terminated immediately. 

USER DATA

We will maintain certain data that you transmit to the Site for the purpose of managing the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. 

You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

SPECIFIC TERMS FOR TRAVELLERS

Subject to any requests (such as completing any verification processes) established by Laulima and / or Hostel, you may apply for a Position made available on the Laulima Platform only after you have paid for the Monthly Subscription. Only then will the respective application process be available.

You understand that Laulima is a platform that only facilitates the connection between you and Hostels, thus it is not our responsibility to guarantee you work. It is within the Hostels interest to connect and select a suitable Traveller subject to their requirements and judgement based on the information you provide on your profile. There'll be the possibility of messages being exchanged between Traveller and Hostel, from where they are free in respect to their respective free will, to establish any additional terms and conditions that they believe is necessary.

You understand that a confirmed placement is one that is agreed upon between you and your chosen Hostel and it is a limited license granted to you by the Hostel to enter, occupy, work and enjoy the Accommodation and other advantages agreed upon for the duration of your stay, in accordance with your agreement with the Hostel.

Any arrangement between you and the hostel made outside the platform (such as financial aid, service or overtime), it is up to you and the Hostel to agree. Laulima can not be held accountable for any issues that may occur from this. 

You agree to abide by the living and working rules set out by the hostel and fulfill your duties to the best of your ability during your exchange with the hostel. In addition you agree to leave the Accommodation no later than the date and time specified by the Hostel on their Profile Page or comply with other mutually agreed time between you and the Hostel. If you stay in the accommodation beyond the agreed period of checkout without the consent of the Host ("Extended Stay";), you will no longer be licensed to remain in the Accommodation, and the Host will have the right to request your departure in a manner consistent with applicable law.

As a Traveller, you are responsible for leaving the Accommodation (including any personal property or other property located in the Accommodation) as it was when you arrived.

You understand that Laulima is not responsible for the quality of your chosen Hostel. It is within your interest to select a Hostel that meets your personal preferences.   

Laulima is not responsible for documentation, travel or health insurance, visas or local legislation, and it is the responsibility of the Traveller to research such matters and prepare their own documentation prior to taking on the exchange.

SPECIFIC TERMS FOR HOSTELS

Subject to any requests (such as completing any verification processes) established by Laulima, you may post a position made available on the Laulima Platform only after you have paid for the Monthly Subscription. Only then will the respective application process be available.

You understand that Laulima is a platform that only facilitates the connection between you and Traveller, thus it is not our responsibility to guarantee you workers. It is within your interest to connect and select suitable Travellers subject to your requirements and judgement based on the information that is provided in the Travellers’ profile. There'll be the possibility of messages being exchanged between Hostel and Traveller, from where you are free in respect to your respective free will, to establish any additional terms and conditions that you believe is necessary.

When creating your Profile and posting a position through the Laulima Platform, you must (i) provide complete and accurate information about the positions you are offering (such as description of the intended help, what is offered in return, location where this exchange will take place, calendar availability and further requirements), (ii) disclose any deficiencies, difficulties and restrictions inherent to the place or position and requirements that apply (such as a minimum Traveller age, visas required for a particular country ); and (iii) provide any other relevant information requested by Laulima. You are responsible for keeping your Profile and posting information updated at all times (including calendar availability).

You are solely responsible for establishing the conditions for the position you post. Once a Traveller applies for an advertised position and you accept it, you must contact the Traveller and address any other condition, detail or agreement directly and exclusively with him or her regarding the exchange that will take place.

Any terms and conditions included in your posting, especially regarding cancellations, shall not conflict with these Terms.

Laulima shall not be liable for damages, actions or omissions of Users, arising from combinations made directly between Users; Laulima only connects Travellers to Hostels.

CHANGES AND CANCELLATIONS

Hostels and Travellers are responsible for any changes to the agreement that they make through the Laulima Platform or directly between them. Laulima is not responsible for confirmations, cancellations and other combinations outside its platform;

Travellers may cancel a confirmed position at any time by informing the Hostel DIRECTLY as soon as possible. If a traveller cancels a trip 14 days in advance or less, they will automatically receive a bad rating which will affect their reputation on our Platform.

Hostels may also cancel at any time by informing the Traveller DIRECTLY as soon as possible. If a Hostel cancels a trip 30 days in advance or less, they will automatically receive a bad rating which will affect their reputation on our Platform. Furthermore, in order to ensure trust and transparency in our community, the following penalties will apply to them:

In the event of repeated cancellations, the Laulima team will evaluate the situation and be tasked to provide further action which may lead to deactivating the profile;

In the case of extenuating circumstances, such as natural disasters, endemic diseases, serious damage to accommodation or changes in the visa or passport requirements of the country, the hostel should contact Laulima to review the trip cancellation record in their profile.

For Travellers, in case of last minute cancellation by the Hostel:

In the absence of availability in the city previously chosen as destination, the Laulima support team reserves the right to find hosts in alternative cities and / or positions that differ from the initial position.

Laulima is not responsible nor covers the transportation costs and/or similar if there is a need to change the destination city during the relocation process.

If cancellation takes place 30 days in advance or more: the Laulima support team will do its best to help you find a new hostel within the travel period shown on the trip confirmation within the platform, but there are no guarantees that it will always be possible.

In certain circumstances, Laulima may decide, in its sole discretion, that it is necessary to cancel a confirmed position and make appropriate arrangements to notify both parties as soon as possible. This may occur (i) when Worldpackers believes in good faith, taking into account the legitimate interests of both parties, that it is necessary to avoid significant losses to Laulima, other Users, third parties or property, or (ii) for any of the reasons set forth in these Terms.

INSURANCE

If, for any reason, the Hostel does not respect what was agreed upon (from the date of arrival), Laulima will assist the Traveller in finding another Hostel nearby so that they can exchange their skills for accommodation. If we can not reallocate the Traveller, Laulima will pay for up to 3 nights in another Hostel, in a shared room, in the same city. The Traveller will be our top priority and we will continue to search for a Hostel or unless another agreement has been made with Laulima; 

Laulima will fully investigate the case from both parties. Laulima Insurance will only be applicable in cases where the responsibility falls entirely upon the hostel; and only during the period of the experience; The start and end dates of the experience are that of which has been previously agreed upon by you and the Hostel, any dates outside of this, Laulima Insurance will not be valid;

Only Verified Members are entitled to Laulima Insurance; Laulima Insurance is valid with each confirmed trip. Laulima Insurance will be provided after the traveller has contacted or reported the case to our Laulima Team. 

GUIDELINES FOR REVIEWS

We may provide you areas on the Site to leave reviews or ratings. When posting a review, you must comply with the following criteria: 

(1) you should have first-hand experience with the person/entity being reviewed; 

(2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language; 

(3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; 

(4) your reviews should not contain references to illegal activity; 

(5) you should not be affiliated with competitors if posting negative reviews; 

(6) you should not make any conclusions as to the legality of conduct; 

(7) you may not post any false or misleading statements; 

(8) you may not organize a campaign encouraging others to post reviews, whether positive or negative. 

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. 

We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.

SUBMISSIONS

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. 

You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

SITE MANAGEMENT

We reserve the right, but not the obligation, to: 

(1) monitor the Site for violations of these Terms and Conditions; 

(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions, including without limitation, reporting such user to law enforcement authorities; 

(3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; 

(4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; 

(5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

MODIFICATIONS AND INTERRUPTIONS 

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. 

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site. 

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. 

We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. 

Nothing in these Terms and Conditions will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.

PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms and Conditions. Please be advised the Site is hosted in the United Kingdom. 

If you access the Site from the European Union, Asia, or any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United Kingdom, then through your continued use of the Site, you are transferring your data to the United Kingdom, and you expressly consent to have your data transferred to and processed in the United Kingdom.

  

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. 

In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

TERM AND TERMINATION

These Terms and Conditions shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS AND CONDITIONS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS AND CONDITIONS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE OR DELETE [YOUR ACCOUNT AND] ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION. 

DISCLAIMER

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SITE AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SITE.
